DRAFT FOR LEGAL REVIEW: not in force. Placeholders in [brackets] must be completed and the whole document checked by a qualified adviser (including consumer law, Scots law and liability caps) before launch.

Terms of service

1. The service

PlotLevels ([Company name to be confirmed]) produces automated, computer-generated descriptions of land from open public data, mainly airborne LiDAR. Reports are generated without human review.

2. What a report is not

A report is not: a measured or topographical survey; a flood risk assessment; planning, legal, valuation, structural or engineering advice; a ground investigation or mining report; or a definition of legal boundaries. You should get professional advice before relying on any figure for design, construction, purchase or planning decisions.

3. Accuracy and data

Outputs are only as accurate as the source data on the date it was captured. Public map layers are queried at the time of your order and may change. Where a check can't be completed, the report says "not checked". We don't fill gaps. Each report describes the shape of the ground from airborne LiDAR and lists public map layers. LiDAR shows the ground as it was when flown and can miss drains, culverts, kerbs, walls and later works; our measured accuracy figures (see data sources and method) apply to open ground and are lower under trees, on steep ground and near buildings. Check anything important on site and with a qualified professional before you rely on it. Plan sheets are not OS location plans and are not for setting out; the site boundary is as drawn by you and is not a legal or title boundary.

4. Ordering and payment

Prices are shown in pounds sterling. We are not VAT registered, so no VAT is charged. Promotion codes, where offered, are entered on the Stripe payment page and their terms (such as end date and number of uses) are shown with the offer. Payment is taken by Stripe at checkout. Your files are generated after payment is confirmed and are usually ready within minutes.

4a. Referral credits

If someone new uses your referral link and makes a first payment of at least £19, you both receive 1 credit. You can't refer yourself, someone on your own team, or an existing customer. Rewards are capped at 20 per person in any 12 months. We may hold a reward for review, or withhold it, if a referral looks like a self-referral. If the payment that earned the reward is refunded, both credits are taken back, even if that takes a balance below zero. Referral credits have no cash value. [To be reviewed by a lawyer before launch.]

5. Cancellation and refunds

Your files are digital content. Before you pay, we ask you to tick a box confirming: "I want my report delivered immediately and understand I lose my 14-day right to cancel once delivery starts". We record that you ticked it, with the date and time, on your order. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 this means your 14-day right to cancel ends once we start delivering your files, which happens straight after payment. If you change your mind before delivery starts, email us and we'll refund you. If we fail to produce your files, we refund you in full automatically.

6. Using the files

You may use the files for your own projects and share them with your advisers and contractors. Attribution notices in the files must be kept, as the data licences require.

7. Liability

[Liability cap, for example limited to the price paid, and exclusions to be drafted by a lawyer. Nothing limits liability that can't be limited by law.]

8. Law

[Governing law and jurisdiction: Scotland, to be confirmed.]
